1. Acceptance of Terms

By accessing or using Nice Fit ("we," "us," or "our"), including our website and desktop application (the "Service"), you agree to be bound by these Terms of Service.

If you do not agree to these terms, do not use the Service.

2. Description of Service

Nice Fit provides a desktop application for generating optimized layouts from user-provided design files.

The application runs locally on your machine. We do not store or process your design files on our servers.

3. Account Registration

To use the Service, you must create an account and provide accurate information, including your name, email address, and password.

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account

We reserve the right to suspend or terminate accounts at our discretion.

4. Free Trial

We offer a 3-day free trial that provides full access to the Service.

• No payment information is required to start the trial
• The trial does not automatically convert into a paid subscription
• At the end of the trial period, access to certain features will be restricted unless a subscription is started

5. Subscription & Billing

Access to the full functionality of the Service requires an active paid subscription.

By starting a subscription, you agree to:

• Pay all applicable fees
• Maintain valid payment information through Stripe

We do not store or process payment details directly.

6. Cancellation & Refunds

You may cancel your paid subscription at any time from your account dashboard on the website.

When you cancel, your subscription is scheduled to end at the end of your current billing period (processed by our payment provider, Stripe). You keep full access to paid features until that period ends. After it ends, paid access ends unless you start a new subscription.

Fees already charged for a billing period are not refunded, and we do not offer prorated refunds or credits for canceling partway through a period you have already paid for.

7. License & Use of Software

Nice Fit grants you a limited, non-exclusive, non-transferable, revocable license to use the application for its intended purposes.

You may not:

• Copy, modify, or distribute the software
• Reverse engineer, decompile, or attempt to extract source code
• Resell, sublicense, or commercially exploit the software
• Use the Service for any unlawful purpose

All rights not expressly granted are reserved by Nice Fit.

8. Ownership

Nice Fit retains all rights, title, and interest in and to the Service, including all software, design, and intellectual property.

Use of the Service does not grant you ownership of the software.

9. Acceptable Use

You agree not to use the Service:

• In violation of any laws or regulations
• To infringe on intellectual property rights
• To distribute harmful, malicious, or illegal content

We reserve the right to suspend or terminate accounts that violate these terms.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind.

We do not guarantee that:

• The Service will be error-free or uninterrupted
• The output generated by the Service will be accurate or suitable for your specific use

11. Limitation of Liability

To the fullest extent permitted by law, Nice Fit shall not be liable for any indirect, incidental, or consequential damages, including but not limited to:

• Loss of data
• Loss of profits or business
• Errors in generated layouts or outputs
• Any damages arising from the use or inability to use the Service

Your use of the Service is at your own risk.

12. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms.

13. Changes to the Service

We may modify or discontinue the Service at any time without notice.

14. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the State of Hawaii, United States.

15. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms.
